A company can lose its exclusive rights to use and register its brand if it allows the mark to become a generic word for the entire set of applicable products instead of a term to identify its specific goods. Terms such as cellophane, escalator, laundromat, thermos, and trampoline are generic terms that used to be proprietary trademarks. A company can reduce the likelihood that its mark will become a generic term if it uses the word BRAND and a generic product description after its mark (i.e., KLEENEX® brand facial tissues). Because leading company brands are often used incorrectly to describe its category of products, test your knowledge of these popular brands, which are used by some as a generic product description but are still registered with the USPTO:
